EULA - End User License Agreement

END-USER LICENSE AGREEMENT

SOFTWARE PRODUCT IMPORTANT-READ CAREFULLY:
This End-User License Agreement ("EULA") is the legal agreement between you (either an individual or a single entity) and www.dennisbabkin.com web-based software company, Dennis A. Babkin, David Chon and other developers included in the software's About window (collectively, "the www.dennisbabkin.com") for the Simple Radio Recorder Scheduler software product (collectively, "the SOFTWARE "). By installing, copying, or otherwise using the SOFTWARE product identified above, you agree to be bound by the terms of this EULA. If you do not agree with the terms of this EULA, do not install or use the SOFTWARE product identified above.

1. GRANT OF LICENSE:

Registration. Any individual or a single entity must register every copy of the SOFTWARE. The registration fee is waived for the first 30 days after initial installation of the SOFTWARE. After that a user will be charged the monetary fee for registration of each copy of the SOFTWARE. The registration is required per-user of a computer system. Once obtained the registration code can be retained for future use by the same individual and/or entity for registration of a single copy of the SOFTWARE at a time. You may not sell, lease, sublicense or in any way distribute the registration information for the SOFTWARE. You may copy this registration information for your own records provided that such copy is not subjected to a public display or distribution.

Installation and Use. The www.dennisbabkin.com grants you a non-exclusive right to use the SOFTWARE on a single computer. For any copy of the SOFTWARE requiring registration you are allowed to make a single backup copy of the SOFTWARE for archival purposes. WWW.DENNISBABKIN.COM RESERVES ALL OTHER RIGHTS NOT EXPRESSLY GRANTED HERE.

Copyright. The SOFTWARE, its logo, graphics and other material included in the SOFTWARE package is owned by the www.dennisbabkin.com and is protected by the copyright laws and international copyright treaty provisions, as well as other intellectual property laws and treaties. Therefore, you must treat the SOFTWARE and any other files and documentation included in the installation as the copyrighted material. You may not use the SOFTWARE for any other purposes other than those described in this Agreement.

2. OTHER RESTRICTIONS

You may not make or distribute copies of the registered version of the SOFTWARE and its registration information, and/or electronically transfer it from one computer to another or over a network. You may not recompile, reverse engineer, disassemble, or otherwise reduce the SOFTWARE to a human-perceivable form. You may not rent, lease or sublicense the SOFTWARE or any of its parts. You may not modify the SOFTWARE or create derivative works based upon the SOFTWARE.

You are allowed to distribute for free the unmodified installation package (installation file) without any limitations.

3. TERMINATION:

Without prejudice to any other rights, www.dennisbabkin.com may terminate this EULA if you fail to comply with the terms and conditions of this EULA. If such is the case, your registration information will become void and you'll be required to destroy all copies of the SOFTWARE.

4. SUPPORT SERVICES:

www.dennisbabkin.com provides technical support services related to the SOFTWARE through the web site (collectively, "the Support Services"). Use of the Support Services is governed by the www.dennisbabkin.com polices and regulations described on the web site, and/or in other SOFTWARE-related materials. Any supplemental software code provided to you as part of the Support Services shall be considered as part of the SOFTWARE and be subject to the terms and conditions of this EULA. With respect to technical information you may provide to www.dennisbabkin.com as part of the Support Services, www.dennisbabkin.com may use such information for its research purposes including product support and development, as well as for posting such information on the FAQ page of the web site. www.dennisbabkin.com will not utilize provided technical information in any form that personally identifies you.

www.dennisbabkin.com does not collect any personal information from its users, nor keeps any mailing lists, sells or sends unsolicited emails to addresses provided by customers. The information that may be retrieved from your computer during the user feedback transaction can include technical information directly related to the SOFTWARE and its use.

5. NO WARRANTIES.

www.dennisbabkin.com expressly disclaims any warranty for the SOFTWARE. The SOFTWARE and any other related documentation is provided "as is" without implied or expressed warranty of any kind, including, without limitation, the implied warranties of merchantability, or fitness for a particular purpose. The entire risk arising out of use and/or performance of the SOFTWARE should remain solely under user's discretion.

6. LIMITATION OF LIABILITY.

To the maximum extent permitted by applicable law, in no event shall the www.dennisbabkin.com or its suppliers and distributors be liable for any special, incidental, indirect, or consequential damages whatsoever including, without limitation, damages for loss of business profits, business interruption, loss of business information, or any other pecuniary loss arising out of the use of, or inability to use the SOFTWARE, or from the failure to provide the Support Services even if www.dennisbabkin.com have been advised of the possibility of such damages.

7. DISCLAIMER.

By installing and running the SOFTWARE you acknowledge that you will not violate any copyright laws in effect in the country, county, state and province that you reside in or acquire recorded material from. You agree to respect the rights of the owners and/or proprietors of the recorded material and hold harmless the www.dennisbabkin.com and its distributors. Any material illegally obtained using the SOFTWARE is done so without any knowledge of the www.dennisbabkin.com and other aforementioned parties and should not be used as a basis for litigation against the authors and/or distributors of the SOFTWARE. All violations are subject to the copyright laws of the United States of America.
